I've done some reseach into this and this is the way I understand it:

California cars are smog exempt if they were produced on or before the 1973 model year. But these cars are only exempt from smog testing during registration. The legislation still requires that all cars have intact the smog equipment appropriate for it's particular year regardless of when it was produced. So if someone calls the smog hotline complaining about a '73 '02 that's spewing black smoke or if one of the remote sensing devices detects foul air coming from a tailpipe, that car can still be called in for inspection to make sure that everything is intact.

Please don't flame me if I'm misinterpreting the lesgislation... I would love for someone else to read up on this (any lawyers out there?) and give an opinion.
