Getting a lemon used 4-speed is always a possibility. That's also true for a 5 speed transmission.

But ask yourself, how many people are qualified (or willing) to tear into a transmission? A used 4-speed is a very common part and in some cases, you can test drive the transmission if the owner already has it in a '02. It's a direct in and out type of swap, no metal cutting, etc.

The 4 speed allows you the time and resources to find a good 5 speed transmission and to collect all of the goodies that you'll need to make the conversion. Unfortunately, not all of us own a welder or know how to weld.
