I don't see why not. I've had my dealer (East Bay) not do various minor things on my previous 328is.

In terms of the DME update, unless you have an aftermarket chip, there shouldn't be a problem updating it. You can ask that they call you first before re-programming, however.

Basically, it's your car, and the dealer should only do those things that you want them to do. If you're polite and show that you're interested in what goes on with your car (as opposed to showing "distrust" towards the dealer), you shouldn't have any problems. If you do, go somewhere else.
