There is no data refering to the E46 yet. I believe the E36 did pretty good. You also have to figure in that BMW makes the safest car in crash tests. (the 5er) With that information you'd have to figure that the E46 would be pretty good. It's also important to note that it is one of few cars that protect the head (with an airbag) in a side impact.

Take a look at the insurance institute website. They also have a link to the Highway Loss Data Institute they have figures on vehicle deaths etc.
