As long as you don't mess with the O2 sensor behind the cat you should be fine (E36 SS exhaust doesn't, don't know about E46). The 02 sensors are merely measuring gas differences across the cat and thus exhaust should have little effect on them, if any. The gas flow should increase but OBDII will adapt to this to some extent.
