I believe in California, it is against the law for a dealer to keep your deposit. You may have broken the contract, but nobody lost anything (i.e, the dealer still got the car).

what my salesperson told me is that your deposit is returned once the dealer sells your car, which should be quite easy for a E46.

I put mine on a credit card just in case I need to dispute it later.
