: It started out very nicely last Saturday as the dealer (Tom Foster, Passport BMW, MD) came to pick us up. It was a beautiful day, and we drove to the dealership, got a run-down on the car, had the paperwork completed, and we were on our way.
: I think we made our first mistake at this point. We were so taken in by the excitement of the new car that despite Tom being unable to demonstrate the memory seat function properly we drove off, thinking that we’ll figure it out by ourselves. Tom went along with this, stating that since it was a weekend day, nothing could be done to check for problems in the body-shop anyway. We also did not do a thorough test drive, being satisfied with just turning the engine on and moving a couple of yards in the driveway of the dealership.
: Just a few minutes after we left the dealership, at our first stop at a traffic light, we felt a bit of vibration in the engine. Immediately all kinds of horrible thoughts went through my mind, but I decided to give the car the benefit of the doubt for a couple of more stops. But the same thing happened in every stop—with the transmission in D, the car vibrated rather substantially.
: Drove back to the dealership and left the car. They were apologetic and gave me a 528i loaner, and assured me that the car will be looked at first thing on Monday. Well, I have talked to the body-shop since, and they seem to be unsure about what the problem is. Apparently there was a software problem, but fixing that bug has not gotten rid of the vibration. No word on the memory seats either.
: I am really concerned about the car at this point, and I am sure I don’t need to state the obvious questions in my mind at this point (lemon?).

if i just paid 35k+ for a nice new car, i would want it to be perfect, there has to be a lemon sometimes, i usually get it, but it looks like you may have this one. its a quality car, quality company, ask to keep the 5 for a loaner until you get a new one.
