Buying a new E46 - damage by people taking a demo (archive)

I notice that the dealers do a demo drive sometimes in new cars. These are then sold as new cars to others.

My question is - does this do a lot of damage to the car by someone really pushing the car; and, can they legally sell a car after this as new?

I guess I'd prefer if my new car had been taken care of, and not used to see "how it performs".
