BMW has decided, in the interest of keeping everyone at the DOT happy, to keep most of their cars limited to 128 mph (~210 km/h). In the old days, a few years ago, it was because many cars had "HR" rated tires (good to 130 mph). Now, they do it just so nobody complains about the Europeans dropping rockets on our shores.

By the way, in Germany they have an "unofficial" limit of 250 Km/h (about 155 mph) so all BMW's are limited to that speed over there - I've heard the E46 M3 can do 180 mph without the governor!
