All european mfgr's have a gentleman's agreement to make DOT happy, electronicly limiting the speed on imports to 128mph. I am sure that a lot has to do with the speed rating on tires. A car may come from the factory with V or Z rated tires, but an owner may put on come cheap rubber and still try to test it. Probably wouldn't be a very pretty picture. Dinan chips may not do much for performance nowadays, but they (like the shark injector et. al.) will remove the governor.
