Just because a car has safety devices doesn't mean the manufacturer will design in the necessity that such devices never fail.

All electrical and mechanical devices are subject to failure.

For that reason, no responsible manufacturer would design in auto-closing windows. BMW forces you to use your key to close all windows, even though the remote will open them all.

Would be some liability issues with possibilty of injury if child/adult got hand/finger caught in sunroof or window.

Not really. Stick you hand in a window. close it, and see what happens. The window stops immediately.
