NOT true, at least in my state. YOU are responsible for having a car that functions properly. Speeding is speeding, and if your Speedometer is off, then it's Speeding and Improper equipment. DONT tell the judge your speedo is off, in my state they just smile and say "Thanks for the confession, guilty as charged and we're appending an improper equipment charge onto the ticket".
