I think you're just got confused from all the answers above. They're correct, you HAVE to pay tax even when purchased from a private party. However, you do not pay this tax to the car's owner, you pay directly to the DMV. When purchased from the dealership, they charge you the tax only because they're handling the paper work for you. I think that fee goes to the DMV eventually.
