I faced the same choice and went with a '98 528 5spd (with the sport suspension). My logic was the same as yours with a few additional thoughts.

I'm also worried about tickets. Even with the 528 I sometimes find myself going at twice the posted speed limit without realizing it. The car seems pretty smooth and willing to accelerate even more.

Also, I'm worried about speed-related accidents and emergencies. I'm not afraid of the limits of the car, but I am afraid of the risk of other drivers, pedestrians, hazards, etc. I drive predominantly in the city and there are all kinds of traps waiting to snap. Even though I might be able to add another 20mph to my already illegal speed down side streets, it's probably getting a bit too dangerous.

When I tested a 540, I had the same reaction I had when I tested a superbike - I couldn't control my own exhuberance. I know now that it's hard enough with the 528. (I must admit, though, that there are times I would like more power and acceleration.)

If I lived in Montana or Nevada and did a great deal of highway driving, I might have a second thought and might go with the 540.

One last thought, to me it seems the handling and steering of the 528 5spd sport is significantly better than the 540. The steering is more precise and I like the way in which the front end of the car can be flipped. I'd like to see slalom speeds of the 528 sport and 540 to see if I'm right on this.
