From what I have been told under Florida law the dealer cannot keep the deposit if the deal is never consumated.
: I was one of 150 customers that ordered the 328Ci with Sport Package only to find when the cars got here that the crucial option was omitted. But this post is not about the '150' problem but about how different dealers across the US react when faced with the same customer service situation. Here's a sampling based on actual posts on this board:
: Dealer A offered their customer to deduct the price of the Sport package and good-will the M Sport wheels and performance tires. - posted by Mark in VA
: Dealer B offered their customer $1000 cash for his time and inconvenience if he re-ordered, or to take the car as is or any car on the lot for $200 over invoice. - Evan
: Dealer C offered to swap out the M Sport wheels/tires and sport seats from another car that was coming. - DougD
: Dealer D offered to install the M Sport wheels/tires and sport seats, customer gets to keep standard wheels/tires and gets $1000 cash off the price. - Stan
: Ferman BMW in Palm Harbor, my dealer, would have none of that. Their idea of compensation was a 'special offer' on Star Spoke sport wheels/tires (which are cheaper than M Sport) for 'only' $1200--even more expensive than the Sport Package itself which includes Sport seats. It was like they were trying to screw me a second time only they made it sound like they were doing me a favor. So I had no fair choice but to cancel the order but this case isn't over until they do me right for my time and inconvenience.
: BTW, their offer on my car (I would later learn) was not the lowest in the area and they're the only one I know that requires a non-refundable deposit of $1000 (others are $500 and refundable). I hope you and others will learn from my mistake.
