This depends on your car.

In Canada (where I am) all E39's came equiped with the 3 tether points in the rear package shelf. If you want the upper anchor brackets they are usually given free by the dealer (in a small packge). They just screw into the place where you remove the plastic screw plug.

I also understand this is now the case with the latest model years in the USA. But previous years did not have the internal anchor points installed.
And that is a real issue because there are no kits (that I know of) to add them.
The problem is that the USA spec cars had a different internal metal package shelf - that did not have the threaded attachment points welded in place. And they also require metal angle brackets to extend from the lower metal package shelf up to the bottom of the fiber package shelf where you attach the anchor hooks.

So that is the background - suggest you discuss with your local dealer.

Or perhaps someone else was able to find another soulution and will chime in on this board.
