RE: John Sain and Elena Sain v. BMW of North America, Inc. and Cain Toyota - BMW, Inc.
Vehicle: 1998 BMW 540i
Our File No.: O2K0949H
Dear Sir or Madam:
Please be advised that I have just received a phone call from my clients regarding their vehicle and BMW's authorized service dealer, Fields BMW's, refusal to honor their warranty and provided any further services due to their claim against BMW. More specifically, Fields BMW's Customer Service Manager, Sabine Heilmayer, notified my clients that due to their disputes with BMW, the dealership would not honor the warranty and that they would have to contact the national office. As you are aware, Fields BMW is not a party to this action and has no basis for blatantly breaching the warranty on BMW's behalf.
My clients are understandably upset over these latest actions by BMW's agents, as the nearest authorized dealership that my clients may go to, that is unrelated to Fields BMW, is not within a reasonable distance.
I would hope that my office is contact immediately so that we may resolve this matter is a timely fashion.
Attorney at Law
