if I were Len, I would definitely SUE BMW-NA, and my own assessment is that this is an open and shut case from the legal standpoint. One of those that never even go to the trial phase because the defendent is so eager to settle.

And no, I am not a proponent of the overly litigious society that the US today is. But sometimes, its just appropriate and I think this is one of those cases. If I sued BMW-NA for this incident and settled, I would give the settlement amount back to BMW-NA to be solely diverted towards their own customer relations department or ombuddsman or something similar.

: Sue? Yes. Win? Another story. I think Len should get a response from BMW - if he want's one. The thought of a lawsuit based on what that guy posted really gets my skin crawling. I wonder if any "ambulance chasers" have contacted Len yet.
