: : Third, while I do not condone BMW's conduct, I've been involved with enough disputes to know that there are two sides to every story. We've only heard Len's side of the story. (As you put it, his "bitching." I won't disagree.) Yes, the engine had a defect. But we don't really know how reasonable (or unreasonable) Len was when the problem arose or as his dealer sought to correct it. He may have aggravated matters through his own conduct.

: : Fourth, everyone in this melodrama is a human being with feelings and emotions. Just because we've purchased BMWs does not give us license to abuse, insult, belittle, and demean individuals who happen to be employed by BMW NA. I'm not saying that Len has committed these sins, but based on the tone of his postings, I can't say that he hasn't.

: : Fifth, attributing every utterance of a BMW employee to the company is silly. There are many anonymous postings here, most of which can probably be traced to a corporate account. Does that mean that the company should be seen as adopting those views? What if the employee uses his/her office telephone to call a radio talk show, without mentioning his/her employer? Would you argue that BMW NA has adopted the political views promoted by the employee?? Whether its the telephone or an Internet connection, company communication resources are being exploited by an employee. The only difference is that the Internet communication is traceable while the phone call is not. This doesn't seem to be a rational basis upon which to make BMW vicariously liable for the comments.

You are a cool guy! I really like people that can admit their faults. Lord knows I have plenty (at least "my boss" lets me know every now and then to keep me in line). :-)
