This is the story I was told quite a while ago from someone at BMW NA: Basically it is a liabilty issue. More US BMW drivers than any other make of car insist on driving with their fog lights on anytime the headlamps are used, good or bad weather. That is bad enough, but the rear fog lights are as bright as and look like brake lights, and if these idiots kept the rear fogs on, driver's behind might think they are just "riding the brake" and possibly follow closer or worse, ignore the brake lights when they are actually used. I have been behind several Jaguar drivers using the rear fogs in such a manner, and it can get VERY annoying. Starting with the E46 3 series BMW is actively attempting to deflect the front fog 'always on' problem by having them shut off each time the car is started. I think this is working as I see far fewer E46s driving with fog lights on in clear weather ;-)
