This has been discussed before. I believe it was found that some of the early E38's had the 5.0 engine.

E38 was never produced with 5.0L V12 as far as I know.
By the way there was something changed on the M73 engine from 09/98, but I don't know exactly what.

All E 38 V12s are 5.4 liters (M73). Ascot Green 750 00:44 6/20/2001 (0)
