In a recent Washington Post column called "Click & Clack", Tom and Ray, who write the column, responded to a question about modest overfilling due to a miscalibrated dispensing gage at a dealership. They basically said that a small amount of overfilling will not likely damage the engine. But went on to say that overfilling by a quart or more, you risk foaming the oil by the crankshaft. If the oil is whipped into a froth, it is mostly air and the oil pump cannot pump air and, therefore, cannot lubricate your engine. There would also seem to be a threat of hydraulic damage to seals. All that extra fluid has to go somewhere. My dealer overfilled, by a couple of quarts, a vehicle of mine during the 15k check. I drove it home, about 15 minutes. After writing to the manufacturer (wasn't my BMW), the dealer sent me a letter guarantying the engine. The letter may not be worth the paper it is written on, but it made me feel better. Suggest you get the dealer to give you written assurances they will stand behind the engine.
