BMWNA called me CALLING ALL ROADFLY MEMBERS (42953 views) (202196 thread views) 
Message: Well in this ongoing drama which many of you here have been nice enough to listen to me and offer support and good wishes, has taken a most unexpected turn. I recieved a phone call from Fran over in BMWNA customer relations. She contacted me on my cell phone while in conference mode with Mark (who had previously told me there was nothing he or BMWNA could do) and stated she apologized for my situation and that she wished there was something she could do but BMWNA could not help me with my situation.

Apparently the major attention here at roadfly under the E38 forum had caused them to contact me again I guess to feel me out. I felt that Fran probably had more authority and knowledge and decided to plead my case again knowing she already had told me no help would be provided. I explained to her I had been a forum member here since 10/98 and am known on the forum more so than your average BMW owner/buyer. I also had told her I am part of a 7 series owners club here on the east coast and part of the national/ international 7 series owners club through roadfly.com and 7er.com in Germany thanks to my new German friend Marc with the Black M7 you have seen posted on this forum. I told her that as she has seen though the posting here I do carry some sort of weight here in the community as can be seen by the amount of responses to my posts regarding my E38 situation lately. Knowing so many BMW owners as well as potential owners are watching to see what unfolds could be a great opportunity I mentioned to her. I promised her should she consider me as a candidate for an engine replacement I would give her a glowing review on this forum and rightfully so since she would be doing the right and fair thing.

Fran said that BMW would not cover it because I bought it from an independent dealer and not a BMW dealer. She told me they should pay for it. I agreed and told her I had just left my newly appointed attorney's office who specializes in Consumer Fraud and he will be addressing this with Fleetway Leasing. I agreed with Fran and told her I will be pursuing litigation with that dealer however it does not excuse BMWNA from the responsibility that was originally theirs. Smoke screening whether I bought it from BMW or not has nothing to do with the hard fact that BMW has acknowledged this is a manufacturer defect. Just because I bought it from an independent who screws me does it give BMWNA the right to pass the buck? I do not believe so since the problem originates with BMWNA it should end there too. As far as Fleetway, they will get theirs for their deceptive business practices.

She stated to me all decisions are decided on a case by case basis to which I replied that I am not your average case as can be seen by the multitude of support and posts at roadfly. She finally asked me if I would consider participating financially toward the repair if BMW picked up the some of the cost and I said NO. I will only agree to them picking up the full tab for the following two reasons: 1. I know through my research BMWNA has replaced the Nikasil block of several E34 5 series and picked up all parts and labor costs though these cars were outside the 6 year 100k mile warranty. One car was even a 93 which is 2 years older than mine. 2. The only reason a BMW Nikasil block fails a leakdown/compression test is because of the presence of a high sulphur content fuel within the engine. The failure is a manufacturers defect and has been accepted as such by BMWNA themselves. My car failed leakdown in cylinders 4 & 8 thereby giving the greenlight for a replacement. The likelyhood of the failure of cylinders 4 & 8 during BMW's 6/yr 100k mile warranty was very high since high sulphur content fuel has not existed in the US marketplace for years and normal fuel would not have caused this problem. Any knowledgeable certified BMW mechanic agrees with this and knows the likelyhood of the loss of compression in my engine could not have just occured between the 100k mile warranty expiration and the 119k miles I have it now. It is just to "convienient" to believe I just missed the warranty. The bottom line is had BMW checked my car within the 6/yr 100k mile parameters there would be no question of coverage. That problem was present then just never checked. Now I get the car and am late for the party (warranty coverage) so to speak and am told there is no coverage because it was not diagnosed in time. I believe it should be grandfathered in because the problem occured while within warranty parameters. The only crime is it was never checked.

They knew I new what I was talking about and I believe it is key. You can't go wrong with being truthful and logical. After I said my peace she told me they will call me back. Again I must tell you should BMWNA come through I will sing their praise till I take the dirt nap. If not, I will not be the only one unhappy with the outcome.

Just to show BMWNA how closely their decision is being watched I would like to ask a favor of my friends here. Many have offered to call Fleetway or BMWNA Customer Relations and I appreciate that. I will not ask for you to do that. What I will ask is to have as many BMW owners from not only the E38 forum but all boards post a reply to this post and see how many people respond, almost like a web petition so to speak. I believe we can make this post reach at least 2 pages long with the replies. This is my only request. My friends, BMWNA is listening and watching so show them how many of us are here and want to see them do the right thing.
