BMW's tend to do strange things with the gas gauge like this. The sending unit is the problem, it reads the resistance along a wire alongside the float. When they get old that perfectly metered resistance is perfect no longer. For that reason I always tell my wife, pay attention to the gas gauge, but if the light comes on, thats what really counts, it is a seperate contact at the bottom of the sending unit.
