Testimonial for Performance BMW in Chapel Hill, NC

On August 1, 2000 I completed an offer to purchase a BMW 323 Convertible (so it could be ordered) and applied $1000.00 against a credit card. The salesman informed me that delivery would require 90 days but at anytime the offer could be canceled and the $1000.00 credited to my card. On August 21, 2000, a salesman from another dealership contacted and said there was a car available that would be delivered the end of October.

I contacted Performance on September 6, 2000 and talked to the salesperson and canceled my offer. The salesperson said that was no problem and said my credit card would be credited. On September 21, 2000 the credit card bill arrived and the charge for the $1000.00 was there but the credit was not. I called the salesperson at Performance on September 22, 2000 and was informed that the credit would be completed that day.

On September 29, 2000 I called the credit card Company to check my account. Unfortunately the credit had not been received. On the same day, I contacted the General Manager of Performance BMW and explained the cancellation of the offer to purchase and the phone conversations I had with the salesperson in hopes of getting the credit processed. The General Manager informed me that he would personally take care of the credit on Monday (since I called on a Saturday) and that if he said something would be done, it would be done. On October 3, 2000 I called the credit card company and once again no credit had been received from Performance. After I called the credit card Company, I called the General Manager and informed him that the credit had still not been received. The General Manager said he would locate the paperwork that day and the credit should be on the card the next day.

On October 6, 2000 I called and the credit had not been received. I called the General Manager and he said he would fax me the credit slip (after he called me) and make sure it was sent to the credit card Company. I did not receive a fax or a phone call. Once again, on October 7, 2000 I called and the credit had not been received. I drove to the dealership and asked for the credit paperwork from the General Manager. The General Manager said the paperwork was locked up but if I gave him my credit card, he would credit my account that day. I asked to speak to his manager, which he located, and informed the higher manager of the events. The General Manager interrupted me and said he would credit my account. I said due to the amount of time it has taken me to get the credit, I expected the $1000.00 plus the amount of money I would have received from a money market account – 5%. Both managers refused so I will take this issue to a lawyer.

I do think a BMW is a good car and will continue to pursue buying one. However, I would not recommend buying one from Performance BMW in Chapel Hill, NC. Other dealers can be located on the BMW web site at www.bmwusa.com.
