If you had taken the time to look at the bottom of the page, there was a picture of the bag that you bought. It looks like a plastic bag to me. I don't think you have much of a case. The item he was selling was clearly displayed. I really don't think you have a leg to stand on.

Whats the link to the ad? Did you complain to Ebay? I sent a complaint to ebay and Paypal about a fraud seller who never sent the product I bought. Ebay said nothing ever while Paypal said I'm right, I win, but had nothing to give me since the seller had no money in his Paypal account. He's been suspended on both but I got nothing and lost my money. At least it was 'only' $37 and not $370 or more.
