My DEC has lasted over 2.5 years without problems. Maybe the cat has hit something which is very possible causing a hole in it. I would suggest checking to see if it really is leaking by looking at it on a cold morning when you first start the car. It might be as simple as a small leak. I found that my car passes NJ and NC inspection without even having to be off of cold start. Now I know that both of those states are not nearly as stringent as CA, but in my last inspection I had the following readings(remember the car was not full warm yet either)

HC(ppm) 079
CO(%) 0.06
CO2(%) 15.1

Engine RPM 810

I think that your problem lies either in an older O2 sensor or that your car, like most BMWs likes to run rich. I would suggest that next time before going, warm up the car then pull the motronic brain for 10 minutes and see if that helps. That should lean out the car so that it will pass emissions. You can also play with the mixture screw on the underside of the air flow meter which I have done many times to get cars to pass. Hope this helps.
