Yes, it's illegal only when the bottle is open. I had the same setup (until I removed it this winter) with a microswitch at WOT and and MSD box to control the operation from 3000-6500rpm. My trigger switch was (from 4-door) rear window circuit breaker I installed on my dash beside the other window switches. I used a NOS dry system at 75HP for 4 years and no destruction was caused.
