Can anyone tell me if it is "legal" for a dealer to with-hold service records for a current owner?

Background: I recently purchased a 94 840Ci from a very reputable dealer. They gave me a print out from BMWNA (I think) which indicated the short block was replaced in 10/99 . This indicated the dealer code that replaced it (not the place I bought it from). When I called them to get a service history, one very nasty service rep told me all they ever did was change the oil! I called back and spoke to the service manager who told me they dont release that info, that the dealer I bought the car from should tell me. They say no.

I have the service book with all the stamps and everything in it for oil change, inspection I, etc. with no mention of the short block. The same previous owner had brought the car to yet another dealer to replace the intake gaskets (or so I am told, since I dont know what the service codes on the printout mean). Same story from them, they wont give out the service records.

Also, fishing around under the hood on my own...there are labels indicating Dinan mods were installed. I'll assume its a chip until i can get in there and verify for sure. But again, no mention of this anywhere in the docs.
