I think they should have known.
That's why we would be willing to spend the extra buck at the dealers as they are supposed to know these cars well.
This guy may have become an expert only when the E38 was already out and so it might not be his fault as he may 'rarely' see a E32.
But it is BMW responsibility that such known problems should be on a checklist for fi idlle problems as to prevent customers from receiving bills for labor and parts that BMW should have known would not solve the problem.

(and now I'm off to law school...I guess)
