I don't see any problem to drive in *. This will indeed give you not all the power, but it will not damage the car.
In sport you will indeed not use the 5th gear. I noticed once problems while driving for many kilometers. Engine becomes hot! (about 160km/hr while weather was very hot)

anyway, I had simular problem, and it was only the switch... I would check out that first, before you look for a new transmission.
