When you buy from a wholesaler under thoses circumstances, he bought the car as is.

I've been to thoses Dealer Only auctions with my BMW dealer's Used car manager. The cream of the crop (Certified BMW's) go to BMW dealers first, what they don't buy goes to the general wholesale public. Something with those many miles was probable sold in the "as is" lane.

He probably got it real cheap!

BMW is not responsible for that. If it was certified, then you would have a claim.
