That would be wrong for safety-related defects, warranty or not, "as is" terms or not. I think it is also wrong for actual defects, unless the manufacturer can make the limitations of the warranty stick. BMW undoubtedly has concerns about that. It would be helpful to know if this person talked to BMW. It's interesting, too, that the seller took the car back, isn't it?
