: I've been to thoses Dealer Only auctions with my BMW dealer's Used car manager. The cream of the crop (Certified BMW's) go to BMW dealers first, what they don't buy goes to the general wholesale public. Something with those many miles was probable sold in the "as is" lane.

That would be wrong for safety-related defects, warranty or not, "as is" terms or not. I think it is also wrong for actual defects, unless the manufacturer can make the limitations of the warranty stick. BMW undoubtedly has concerns about that. It would be helpful to know if this person talked to BMW. It's interesting, too, that the seller took the car back, isn't it?
