You must have talked to some imbecile at BMW. Even I know they've been required by law to have them in U.S. models. I think this started back in the early to mid-seventys(1972 comes to mind). I believe the part number you need to refer them to is 16-14-1-179-282. You'll find this inside the intank fuel pump. unbolt the hose at fuel pump then underneath you find it bolted into the fuel pump. Have them blow thru it in either direction you can't if it's working properly, only the fuel pump produces enough pressure to open the valve in the one direction that it can. See page 160-2 of Bentley it's the item between the fuel pump #2 and fuel fitting. This valve keeps pressure in the fuel line at shut off and stops flow out of the tank if the vehicle turns over and stalls.

I have had my German imported '94 540i help by DOT
for over 4 Months. The latest reason is they want to see evidence of a fuel line check valve (in case of roll over)- BMWNA says that part does not exist - but DOT will not release my car until I show proof of installation. HELP!!!
