I have a '99 540i and had my whole trans replace at 12k miles. The reason is that there was a bushing in the shift linkage system that caused the gears to not be fully engaged. There could simply be an alignment problem with the shift linkage or you need a new bushing on the shifter. I would try these first as it is the easiest to tackle and the cheapest. The other problem could be with the synchromesh and the tranny bushings. The tranny bushings could be worn out compared to the engine bushings, if new ones were put in.

I hope this throws you into the right direction.

I recently purchased a 530i, which recently had the engine block replaced. Now, when the car is cold, the transmission pops out of 4th gear immediately after shifting and 2nd if you power hard. Previous owner claims this was not a problem before. Does anyone else experience this problem or have any ideas on what this might be.
