In answer to your question, no -- no 3.8l M5s were ever imported by BMW NA for the U.S. market. ALL U.S. spec E34 M5s are 3.6l machines.

If such a car (3.8l) does exist in the United States, it would have to be a "federalized" European version; however, my understanding is that is is nigh unto impossible to get one through the EPA certification process. While it can probably be done with enough effort and expense, the defanged/detuned 3.8l would probably deliver performance that was actually inferior to the standard 3.6l -- or worse. The bottom line is that you will likely pay twice as much for a car that performs half as well. That said, I would be looking for a well-maintained 3.6l! Good luck in your search!
