The *same* problem happeneing 3 or more times after the dealer has attempted to fix it.

give the dealers a chance to fix it.
no they're not legally liable to give you a new car.

Okay folks, here goes...

Let me preface this message with this.. .I love my 323.. when it works.

I've now got 1400 miles on my car, which I took delivery of on 6/26/00, after waiting for 3 months for delivery.

Within the first week of having my car, it developed a problem - the power steering pump failed. I took it into service, where I was told I would have it back the next day. Needless to say, that didn't happen. So, I was stuck, without a loaner for 5 days. After that, I was given a loaner, and 3 days later, my car came back. Great. One flaw is acceptable.

Next item.

Friday night I was driving out of town, and a bug hit my windsheild. I pulled on the windshield wash lever, and it went limp. Then the wipers went nuts. It seems to me that the lever itself broke - it's completely loose... I can adjust it around, and get to all the functions, but as soon as I let go, it falls all the way down, and towards me... In other words, on intermittent and spraying fluid. Good thing it's got a 5L resevoir. Anyways, because I was out of town, and without a BMW service center in the immediate vicinity, I stuck it in the correct location (being OFF... there isn't much use for continuous windsheild wiping in Phoenix) using masking tape.

I got back into town today, and left a message for the service department. I expect a call from them tomorrow.

Okay, that's two strikes. But wait, there's more.

Tonite, I decided to roll down the two front windows to listen to the car a little - when I decided to roll them back up - only one of them did. The passenger side window will not roll up all the way. It makes alot of noises when it tries, and it's not a squeaking or squealing like in the FAQ... It sounds like the mechanism is slipping or something.. Loud crunchy noises.

Needless to say, I am *VERY* unhappy. I love my car, but it just keeps breaking.

A fair number of people I've spoken to have recommended that I get the car replaced, or have the car bought back under lemon law, but I'm not very familiar with it. From looking at it, it sounds like it has to go into the shop a few more times before it falls under the 'lemon' category. It's just very disheartening - 1400 miles, and 3 things have broken! I mean, the moonroof not working all the time, I'm patient enough with - I read the FAQ, and know what to do...

A few other people recommended litigation if they won't replace the vehicle or issue a buyback..

I'm a little confused as to what my options are, and at this point, I'm very very irate...

To finish this off, I hit IRC to find out if anyone had similar problems, and someone in #MPower suggested I present this issue to Kev, because evidently he had a similar issue.

So, any suggestions folks? I'm at my wit's end.
