Well, I figured it out- I just have to get the guy to want to buy the car again (since he was first going to buy it, then was set on taking over the lease).
Basically, if you want to avoid tax- pay a dealer (usually $500)- to do the transaction. Your brother would cut the dealer a check first- the dealer will buy the title and transfer over the title into your brothers name- the dealer will handle the tax and plates (convenient).

Most dealers won't have an issue doing this, because its money they wouldn't have had anyway- so $500 is $500.

So, after days of BSing with BMW, this is the most cost effective and easiest way- trust me
