In my experience with my '98 M3, Euro delivery at a discount is only available on vehicles that don't come out of dealer allocations - that is, when BMW has no problem meeting dealer demand for that particular car and is willing to take non-allocation orders. For the E46 M3, it sounds like dealer demand and waiting lists won't be sated for quite a while. Several dealers have told me that I can go to Munich to pick up the new M3, but I'd have to pay their normal price. This'll probably be the case until M3 production hits it's stride and demand goes down - 6-8 months as posted in another thread.
Can a prospective M5 purchaser walk into a dealer tomorrow, indicate that they want to take Euro delivery of an M5 at, say, the end of November, and then actually do it???
I'd bet the answer is yes, but no discount: it would have to come out of some dealer's allocation of this hard-to-get car and he'll charge you what he would any US delivery customer.
