The point is that many other manufacturers sell cars in the US with cross-drilled rotors. They are a proven commodity. Also, fwiw, Porsche, having been seriously burned in litigation, is more afraid of litigation than BMW. Finall, about the spilled coffee judgment, it was set aside on appeal.
