Miami dealer selling M3 over MSRP (archive)

Two days ago I recieved in the mail my M3 deposit returned from my dealer that I placed 3/3/99. It was with a letter from the new car manager stating "They are unsure of manifacturing dates and no longer want to retain costomers monies." I later that day went to speack to him in person. After him beating around the bush for a while I finally got him to tell me that they are only alocated 34 cars for 2001 MY and have a list containing over 150 names. They are returning deposits, "but keeping the list for refrence." Because there is going to be a shortage of cars they are going to be selling cars with "AVAILABILITY PREMIEUMS in amounts that are at this time not known." Early this year I went to the same dealership to purchase another car and saw a M5 in the showroom with a invoice on it's window with an "AVAILABLITY PREMEIUM" of $25,000.
The dealership is South Motors BMW located in Miami FL.
I am curious if any one of you know if BMW endorses these type of activties?
If not what can be done?
P.S. I am #2 on a list in Orlando...hopefully not totally screwed!
