If you did not have the spot in Orlando, you might have had some legal recourse. If you get screwed in Orlando too, take both of the bastards to court. Assuming they initially promised you a car at MSRP you could argue that you missed an oportunity to go elswhere by relying on their promise to sell you the car at MSRP. IF you never got that promise (whether in writing or by oral agreement).

I still can't understand why BMW puts up with this crap. Are the dealerships splitting the extra profits with BMW? Does BMW get some type of perk beyond alienating their customers. I know the dealer gets an extra bonus, but the image for BMW is poor. They put themselves right up there with the Chevy Dealers that decide to sell the Z06 at a market premium, and when you ask why they dare you to say it isn't worth it. Meanwhile, Porsche has one of the most loyal customer base around. Could they sell their cars at a premium? You bet. Do they? Nope. Why? Because Porsche Cars of North America will yank their allocation and could even yank their dealership. The result is that a Porsche customer knows that when he puts his name on that list, the most he will pay is sticker. He wil never have to worry about getting his deposit back in the mail with a letter saying the cars will be sold with availability premiums. On this issue BMW jsut plain Sucks!


Two days ago I recieved in the mail my M3 deposit returned from my dealer that I placed 3/3/99. It was with a letter from the new car manager stating "They are unsure of manifacturing dates and no longer want to retain costomers monies." I later that day went to speack to him in person. After him beating around the bush for a while I finally got him to tell me that they are only alocated 34 cars for 2001 MY and have a list containing over 150 names. They are returning deposits, "but keeping the list for refrence." Because there is going to be a shortage of cars they are going to be selling cars with "AVAILABILITY PREMIEUMS in amounts that are at this time not known."

Early this year I went to the same dealership to purchase another car and saw a M5 in the showroom with a invoice on it's window with an "AVAILABLITY PREMEIUM" of $25,000.

The dealership is South Motors BMW located in Miami FL.

I am curious if any one of you know if BMW endorses these type of activties?

If not what can be done?


P.S. I am #2 on a list in Orlando...hopefully not totally screwed!
