MBUSA will cut a dealer's allocation if they find out a dealer is adding a premium to MSRP. However, dealers get around it by selling them to their salesman or selling them to other dealers, then reselling the cars as "used" with 100 miles or so for a hefty premium. Lately, they've also been doing things like adding dealer installed chrome wheels for $10,000.

It's not BMW's fault for not doing anything about it. Dealer's will figure out some legal way to get the maximum price the market will pay.
