Although you may be on firm ground about the level of pressure the manufacturer can put on dealers to stick to MSRP, the situation here is somewhat different.

We have a dealer who took money from a customer and agreed to sell a car at MSRP in writing. That dealer is now backing out of the bargain upon seeing high demand and opportunity to make extra cash. THIS is the practice which must be stopped and which is very likely to be upheld should the customer take the dealer to court.

I also think that BMW would be on very strong ground to sanction a dealer that breaks contracts with customers after money has changed hands.

This is not about price fixing. It is about integrity.
