Exactly, as you have said. While BMW could prevent dealers from marking up new cars ala Porsche, the only thing you are going to see in response is that dealers are going to be selling "used" M3's with 5 miles on them, instead of selling them as new.

Unfortunately, some people value the quick buck over long-term customer relations and doing what is morally right. BMW can try as hard as they can to eliminate this behavior, but unscrupulous delaers will always circumvent whatever rules BMW sets up to prohibit mark-ups over MSRP.
