IF you have a something from the dealer in writing stating that in return for your deposit you have the right to purchase an M3 at MSRP, then what the dealer has done is not capitalism, it's trying to illegally break a contract!

Here's what I suggest:

1) Set up a meeting with the dealership's general manager.

2) Write a letter addressed to the dealership that clearly states your case with the attorney general of Florida, the local newspapers, the BBB, and your attorney cc'd at the bottom, along with any consumer protection groups you can think of.

3) In your meeting, state your case clearly to the GM, that you've had this contract with the dealership for 9 months and now the dealership is attempting to renig on their commitment. State it first in terms of customer satisfaction, then in terms of contract law.

4) If the GM grants you your spot at MSRP, good, your done. If not hand him a copy of the letter, tell him where it is going next, and tell him you can expect to hear from your attorney.

5) Your attorney will probably contact the dealership and try to arrange the deal. Hopefully by this point the dealership will see the error of its ways and make a business decision to let you have yours instead of fighting this. Work with any group that responds to your letter in 3 above to put pressure on the dealership to honor their commitment.

6) If not, file a lawsuit and subpoena the entire M3 waiting list. Contact each member on the list and start a class action lawsuit and also go after punitive damages. Drag the dealership's name through mud.

I have twice followed tha above steps and I'm 2 for 2, in one case the letter was all that was needed, the second a phoone call from my attorney was all it took. It helps that my attorney was a friend who was happy to help pro bono at least for the first few calls.
