: How about by the tone of your screams when the service manager mentions that they "updated the DME software with the latest service bulletin", which is what they did (without asking) the last time I had my M3 in for service. Since the update they did was the one that makes the motor more compliant with emissions requirements, I now have the cold start problem ALL the time, instead of just in cold weather! The car's not sharked (yet) , so they didn't overwrite anything, but this is how it could happen. Or, when you tell them NOT to update the DME, what are they going to think your reason was??!

: OTOH, they would have to prove the software caused a problem for it not to be covered under warranty. The service manager at my dealer actually recommends JC software -- he and most of the rest of the shop have it on their cars.

this is what Jim said to tell the dealer..."Don't do ANYTHING to my car unless you have it is writing, and this includes ANY open campaigns." Or something to that effect.
