Burned out clutch? (archive)

Hey, doin' a little footwork on behalf of my brother. He has a '97 M3 w. the Luxury Package. He travels a lot, so the car is basically only used on the weekends. Anyways, the clutch is shot. It's been slipping over the past several weeks and finally went last week. The car has 35k. miles. And I know that he doesn't drive it that hard (no popping the clutch, no racing, etc.). It's at this dealer this week for diagnosis. Soo... what gives? Are these clutches that bad? I mean, I drive my GTI VR6 much harder than he does his car and the clutch is fine at almost 50k. What we're concerned about is that the dealer will try to pin the blame on him and not honor the warranty.
Any tips? Screw the dealer and go aftermarket maybe..?
