Okay, in my court date packet I recieved, it says I have the right to a trial within 45 days of my original court apperance (plea entry). If I sent my check in and plead guilty, does this count as a proxy appearance? The reason I ask is my check was recieved (processed) on 5/31, court date has been assigned to 9/14. This seems like a LONG time from the traffic stop, certainly not 45 days from my original plea. Is the plea the original court date, even if it was mailed in? Can I have the case dismissed based on a violation of my rights? Thanks.
