Absolutely it's available from any BMW dealership's parts department. They should have an ample supply always on hand as the E39 M5 uses this oil exclusively.

I know my local dealership has it in stock. I've seen it and I have a friend that has one of the new M5s and he has gotten some from the dealership more than once.

Apparently the parts department employee was new or not aware of their stock. It's not a common viscosity weight by any means and since only the new M5 uses it maybe your dealer hasn't had to service one yet...but they should still have a case or so in stock.
